The Sharing and Caring Verein (TSCV)

​

1. General provisions

These rental terms and conditions are an integral part of the rental agreement. The vehicle is managed by the TSCV, hereinafter referred to as the lessor. The rental company and the renting party are the sole contracting parties. All rentals begin at the pick-up location specified in the rental agreement and end when the vehicle is returned to the rental company's location. All prices are in Swiss francs (CHF) incl. 8.1 % VAT.

2. Reservation, deposit and payment

At the latest at the start of the rental period, a deposit of CHF 1,000 for tenants residing in Switzerland or CHF 2,000 for tenants residing outside Switzerland is due, unless otherwise agreed. This deposit also constitutes the deposit, which will be refunded if it is returned correctly (cf. Art. 4). The vehicle is only considered reserved after receipt of the deposit. The total rental costs must be transferred at least 1 day before the start of the rental period. Deposits at the post office counter are to be avoided; any fees will be passed on. In the event of non-payment, the landlord reserves the right to take legal action and can commission a collection agency. In this case, the tenant bears all collection costs (legal advice, address research, communication, reminder fees and processing fees).

3. Withdrawal from the contract

In the event of withdrawal from the contract by the tenant before the start of the rental period, the following portions of the total price are owed:up to 90 days before the start of the rental period: CHF 150 lump sum; 89–60 days: 30%; 59-30 days: 60%; 29 days until the start of the rental period: 100%.

4. Pick-up & return of the vehicle

The times and locations noted in the rental agreement apply. When handing over and returning, a protocol is drawn up and signed by both parties. The vehicle will be handed over in perfect, clean condition. Hidden defects must be reported in writing within 24 hours of the start of the rental. Upon return, the vehicle must be cleaned inside and the accessories must be complete. A flat rate of CHF 89/h will be charged for post-cleaning. The battery charge level must be at least 80% at the time of return (or as at pick-up, if lower). If the charge level is lower, the landlord charges a flat rate of CHF 150 in addition to the electricity costs. Late return: 5–10 min. CHF 30.–; 10–30 min. CHF 50.–; 30–60 min. CHF 100.–; 60–120 min. CHF 200.–; each additional hour CHF 200. Early return or lower mileage do not entitle you to a rent reduction. If the vehicle fails as a result of an accident or other causes beyond the fault of the Lessor, the Lessor will endeavour to find a replacement. If a replacement vehicle is not available, payments will be refunded in full. Further claims are excluded.

5. Handlebars

All drivers and additional drivers must be reported to the rental company before the start of the rental. The minimum age is 24 years and possession of a valid category B driver's license for at least 48 months is required. Exceptions can be granted by the landlord; in this case, the tenant is fully liable for all damages.

6. Due diligence

The tenant undertakes to use it carefully and in accordance with the law. The charge level and tyre pressure must be checked regularly. The vehicle may not be charged with fast chargers without manufacturer approval. Loading equipment must be handled with care. The tenant is liable for damage caused by improper handling.

7. Liability & Insurance

By signing the handover protocol, the renter confirms that the vehicle has been inspected and found to be in good condition. The tenant is liable for all damages incurred during the rental period, unless they are due to normal wear and tear or material defects.Insurance: Fully comprehensive insurance (deductible CHF 1,000). Drivers under the age of 25 pay CHF 3,000 per claim. Damage caused by incorrect loading, deep discharge, damage to loading equipment, tyres or accessories is not insured.

8. Fees & Energy

The costs for electricity, tolls, tunnels, ferry connections and other road tolls are borne by the tenant. The Swiss motorway vignette is included in the rental price.

9. Repairs & Breakdowns

In the event of a breakdown, the lessor must be contacted immediately and further instructions must be awaited.

10. Instructions of the landlord

Instructions of the lessor (e.g. loading ban, restriction of use, workshop instructions) must be strictly followed. Failure to comply with this leads to the liability of the tenant for all consequential costs.

11. Accident & Theft

Accidents or thefts must be reported immediately to the police and the lessor. The accident report in the vehicle must be completed and supplemented with photos, sketches and witness information. It is not allowed to make any admission of guilt on behalf of the lessor.

12. Traffic violations

The tenant is solely liable for all traffic and parking fines. The lessor can forward personal data to authorities.

​

13. Prohibitions

No smoking in the vehicle. Animals only with the consent of the lessor. Re-letting prohibited. Advertising may not be changed. Journeys outside Europe as well as in Russia, Belarus, Ukraine, Iran, Armenia, Georgia, Azerbaijan, Kazakhstan and Kosovo are prohibited. Use under the influence of alcohol, drugs or medication as well as for learning, racing or off-road driving is prohibited.

14. Place of Jurisdiction

By completing the booking, the renter confirms that he has read, understood and accepted the T&Cs. The place of jurisdiction is Basel (BS).
